On Wednesday, the Appeal Court in Port Harcourt dismissed an appeal brought by Ojukaye Flag-Amachree, an APC candidate for governor in Rivers State, against the decision of the Federal High Court in a case brought by George Orlu and four others against the Independent National Electoral Commission, INEC, and the APC.
Flag-Amachree had approached the Appeal Court with the claim that Tonye Cole, George Orlu, and the other plaintiffs in the High Court lawsuit did not take part in the primary process and as a result, he (Flag-Amachree) should be recognised as the legitimate candidate if Cole is found to be incompetent.
But the three-member appeals panel, which was presided over by Justice O.A. Adegbehingbe, rejected the case for lack of merit in a unanimous decision.
According to the appeals court, if the plaintiff’s request for relief is approved, the party would need to hold new primaries and congresses.
Additionally, was mentioned that Flag-Amachree didn’t object to the primaries despite losing them.
