Appeal Court Overturns Judgment on Rivers State Allocation Seizure
PulseNets has learnt that the Court of Appeal has nullified a controversial judgment by the Federal High Court that sought to seize Rivers State‘s statutory allocation. This pivotal ruling was delivered today, December 13, 2024, by Justice Barka.
In what is being described as a landmark decision, Justice Barka stated that the Federal High Court lacked jurisdiction to entertain the case brought forward by Martin Amaewhule and his associates. Speaking to PulseNets, legal analysts noted Justice Barka’s emphasis that including federal agencies in a lawsuit does not automatically grant jurisdiction to the Federal High Court.
Justice Barka further clarified that issues involving a state’s appropriation fall outside the purview of such a court, stressing that the Federal High Court should not have handled the matter. His ruling reaffirmed the jurisdictional principles governing state governance matters.
